Texas is the only State in the West where rule of capture determines ownership of water. Groundwater is precious and scarce and drought and more drought is causing a shortage. This sad law explains why the El Paso Water Improvement District wells next to the Rio Bosque Wetland Park is swigging the water in the park and dramatically dropping the water table. It explains why there is a need for radical reform of our water laws regarding control and conservation of water.
